Terms and Conditions – ChefSmaak
1. Scope and Contracting Party
The contracting party is EatFirst Netherlands B.V., registered in the Netherlands.
These general terms and conditions apply to all agreements between ChefSmaak and its customers for the provision of catering and related services.
Any deviating terms provided by the customer will not apply unless ChefSmaak has expressly agreed to them in writing.
ChefSmaak provides services to both private and business customers.
2. Services and Offer
ChefSmaak offers various catering services via its website www.chefsmaak.nl and by phone, including:
Delivery of food and beverages
Rental of crockery, cutlery, and equipment
Provision of staff
Additional services such as decoration or furniture rental
Images of dishes shown on the website are for illustration purposes only. The actual products may differ slightly.
3. Orders and Contract Formation
An order placed via the website becomes binding only after written or digital confirmation from ChefSmaak.
We reserve the right to refuse an order or propose an alternative if delivery on the requested date or to the specified location is not possible.
For telephone orders, the offer will be confirmed via email. The contract is concluded once the customer confirms this offer in writing.
4. Delivery and Performance
Delivery takes place at the address and time specified by the customer.
Any changes in location or time must be communicated and confirmed in writing at least three business days in advance.
ChefSmaak may engage local partners or subcontractors to fulfil the order.
5. Customer Responsibilities
The customer is responsible for providing accurate and complete information when placing an order and must be present at the agreed time to receive the delivery.
Any complaints or defects must be reported immediately upon delivery by email, including photographic evidence.
In the event of damage to or loss of rented materials, ChefSmaak may charge a compensation fee according to the current price list.
6. Prices and Payment
All prices include VAT unless otherwise stated.
The minimum order value is €199 per order.
Payment methods include iDEAL, credit card, bank transfer, or invoice (for business customers).
ChefSmaak reserves the right to request a deposit, depending on the order amount and event type.
For large orders (from €3,000 or more), up to 100% prepayment may be required.
7. Changes and Cancellations
Changes to the order are possible up to three business days before the delivery date, provided they are confirmed in writing.
Cancellations are free of charge within the following timeframes (depending on order value):
Up to €500: 3 business days in advance
Up to €1,000: 5 business days in advance
Up to €2,000: 2 weeks in advance
Up to €10,000: 3 weeks in advance
Over €10,000: 8 weeks in advance or by individual agreement
After these periods, ChefSmaak reserves the right to charge the full order amount.
8. Liability
ChefSmaak is liable for damages resulting from intent or gross negligence.
In cases of slight negligence, liability is limited to foreseeable, direct damages.
Liability for consequential damages, loss of profit, or indirect damages is excluded.
Statutory liability for personal injury and product liability remains unaffected.
9. Data Protection
ChefSmaak processes personal data in accordance with applicable data protection laws (GDPR).

10. Final Provisions
Contracts with ChefSmaak are governed by Dutch law.
In the event of disputes, the competent court in Amsterdam shall have jurisdiction.
If any provision of these terms is found invalid, the remaining provisions will remain in full effect.
