Part of the data is used to ensure that the website functions correctly.
Other data may be used to analyse user behaviour and improve our services.

What rights do you have regarding your data?

You also have the right to request the correction, blocking, or deletion of this data.
If you have questions about data protection, you can contact us at the address provided in the Legal Notice.
You also have the right to file a complaint with the relevant supervisory authority.

In certain cases, you have the right to request the restriction of the processing of your personal data.
Details can be found in this Privacy Policy under “Right to Restrict Processing.”

1.3 Analytics Tools and Third-Party Tools

When you visit our website, your browsing behaviour may be analysed for statistical purposes.
This happens mainly through the use of cookies and analytics programs.
Your browsing behaviour is usually analysed anonymously and cannot be traced back to you personally.

More detailed information can be found in the following sections of this Privacy Policy.
We will also explain your options for opting out of such analysis.

2. General information and mandatory information

2.1 Data Protection

The operators of this website take the protection of your personal data very seriously.
We treat your personal data confidentially and in accordance with applicable data protection laws and this Privacy Policy.

When you use this website, various personal data are collected.
Personal data refers to information that can be used to identify you personally.
This Privacy Policy explains which data we collect, how we use it, and for what purpose.

Please note that data transmission over the Internet (e.g., communication by email) can have security vulnerabilities.
Complete protection of data from access by third parties is not possible.

2.2 Information About the Responsible Entity

Responsible for data processing on this website:

ChefSmaak
Arlandaweg 92
1043 EX Amsterdam
Telephone: +31 (0)85 200 6166

Data Protection Officer
R. Stevens
Email: richard.stevens@caterdesk.nl

The responsible entity is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).

2.3 Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your explicit consent.
You may revoke your consent at any time by sending us a simple email.
The legality of the data processing carried out prior to the revocation remains unaffected by this withdrawal.

2.4 Right to Object to Data Processing in Special Cases and to Direct Marketing (Art. 21 GDPR)

If data processing is carried out based on Article 6(1)(e) or (f) of the GDPR, you have the right to object at any time to the processing of your personal data for reasons arising from your particular situation.
This also applies to profiling based on these provisions.
The applicable legal basis for each processing operation can be found in this Privacy Policy.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms, or if processing serves to establish, exercise, or defend legal claims (objection under Art. 21(1) GDPR).

If your personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing; this also applies to profiling insofar as it is related to direct marketing.
If you object, your personal data will no longer be used for direct marketing purposes (objection under Art. 21(2) GDPR).

2.5 Right to Lodge a Complaint with a Supervisory Authority

In the event of a violation of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or place of the alleged infringement.
The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

2.6 Right to Data Portability

You have the right to receive data that we process automatically on the basis of your consent or in fulfilment of a contract, in a commonly used, machine-readable format, and to have it transmitted to yourself or a third party.
If you request the direct transfer of the data to another controller, this will only be done if technically feasible.

2.7 SSL or TLS Encryption

For security reasons and to protect the transmission of confidential content (such as orders or inquiries sent to us), this site uses SSL or TLS encryption.
You can recognise an encrypted connection by the browser address line changing from “http://” to “https://” and by the lock icon in your browser bar.

When SSL or TLS encryption is active, data transmitted to us cannot be read by third parties.

2.8 Encrypted Payment Transactions on This Website

If, after entering into a paid contract, there is an obligation to provide your payment details (e.g., bank account for direct debit), this data will be required to process your payment.

2.8.1 Visa / MasterCard, Direct Debit

Payment transactions via standard payment methods (Visa, MasterCard, direct debit) are conducted exclusively via an encrypted SSL or TLS connection.
When encryption is active, your payment data transmitted to us cannot be read by third parties.

2.9 Information, Blocking, Deletion, and Correction

Within the scope of applicable law, you have the right at any time to obtain free information about your stored personal data, its origin, recipients, and the purpose of data processing.
You also have the right to request the correction, blocking, or deletion of this data.
You can contact us at any time using the details provided in the Legal Notice.

2.10 Right to Restrict Processing

You have the right to request the restriction of the processing of your personal data.
You can contact us at any time for this purpose.
This right applies in the following cases:

  • If you contest the accuracy of your personal data, we will need time to verify this. During the verification period, you have the right to restrict the processing of your data.

  • If the processing is unlawful, but you prefer restriction instead of deletion.

  • If we no longer need your personal data, but you require it for legal claims.

  • If you have objected under Art. 21(1) GDPR, while it is still being determined whose interests prevail.

If processing is restricted, such data may only be processed (aside from storage) with your consent, for legal claims, or for reasons of important public interest.

2.11 Objection to Promotional Emails

We hereby object to the use of contact data published in the context of our legal notice obligations for sending unsolicited advertisements and information materials.
The website operators expressly reserve the right to take legal action in the event of unsolicited promotional information, such as spam emails.

3. Data collection on our website

3.1 Cookies

Some of our webpages use cookies. Cookies do not cause any harm to your computer and do not contain viruses. They help make our services more user-friendly, efficient, and secure.
Cookies are small text files stored on your device by your browser.

Most of the cookies we use are “session cookies”, which are automatically deleted after your visit.
Other cookies remain stored on your device until you delete them — these enable us to recognise your browser on your next visit.

You can set your browser to inform you about the placement of cookies, to allow cookies only in individual cases, to exclude their acceptance for specific cases or altogether, and to automatically delete cookies when you close your browser.
Disabling cookies may limit the functionality of this website.

Cookies that are necessary to carry out the electronic communication process or to provide certain functions requested by you (e.g., shopping cart) are stored based on Art. 6(1)(f) GDPR.
The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services.
Other cookies (e.g., for analysing user behaviour) are treated separately in this Privacy Policy.

3.2 Server Log Files

The website provider automatically collects and stores information in server log files, which your browser automatically transmits to us. These include:

  • Browser type and version

  • Operating system used

  • Device type (PC, tablet, or smartphone)

  • Screen resolution

  • Referrer URL

  • Hostname of the accessing computer

  • Time of the server request

  • IP address

  • Origin (city)

This data is not combined with other data sources.

The data is collected based on Art. 6(1)(f) GDPR.
The website operator has a legitimate interest in ensuring the technical functionality and optimisation of the website, for which server log files must be recorded.

3.3 Contact Form

If you send us inquiries via the contact form, the data entered in the form — including your contact details — will be stored by us for the purpose of processing your request and in case of follow-up questions.
We do not share this data without your consent.

If contacting us via the form leads to a contractual relationship, your data may be shared with third parties only to the extent necessary for contract execution (e.g., with delivery companies or payment processors).
Your data will not be passed on to third parties for advertising purposes without your explicit consent.

The processing of data entered in the contact form is based solely on your consent (Art. 6(1)(a) GDPR).
You may revoke this consent at any time by sending us a simple email.
The legality of processing carried out before the revocation remains unaffected.

Your contact form data will be retained until you request deletion, withdraw your consent, or the purpose for storage no longer applies (e.g., after your inquiry is resolved).
Legal obligations — especially retention periods — remain unaffected.

3.4 Registration on This Website

As a caterer, you can register on our website to access additional features.
We use the data provided during registration only for the purpose of offering the respective service or feature you registered for.
All required information must be provided in full; otherwise, registration will be refused.

The personal data collected may include your name, surname, and email address (or those of your company representative).

We use the registered email address to inform you about important updates, such as changes to our offerings or technical adjustments.

Processing of registration data is based on your consent (Art. 6(1)(a) GDPR).
You may withdraw your consent at any time by sending us a simple email.
The legality of processing prior to the withdrawal remains unaffected.

Data collected during registration will be stored for as long as you remain registered on our website and deleted thereafter, unless statutory retention obligations apply.

3.5 Processing of Customer and Contract Data

We collect, process, and use personal data only to the extent necessary for establishing, structuring, or modifying the legal relationship (inventory data).
This is done based on Art. 6(1)(b) GDPR, which allows processing of data for the performance of a contract or pre-contractual measures.

We also collect, process, and use personal data related to the use of our website (usage data) only to the extent required to enable the use of our services or to bill for them.

3.6 Data Transfer When Concluding a Contract for Online Orders, Dealers, or Shipping

We transfer personal data to third parties only when necessary for contract processing — for example, to delivery companies responsible for shipping goods or to financial institutions managing payments.

Further data transfers do not occur unless you have explicitly consented to them.
Your data will not be shared with third parties for advertising purposes without your express permission.

The legal basis for this data processing is Art. 6(1)(b) GDPR, which permits data processing necessary for fulfilling a contract or taking pre-contractual steps.

4. Social Media

4. Use of Social Plug-ins

We use social plug-ins from the networks Facebook, Twitter, Instagram, and LinkedIn on our website, based on Article 6(1)(f) GDPR.
The underlying purpose — improving our marketing activities — constitutes a legitimate interest under the meaning of the GDPR.
The respective providers are responsible for operating these plug-ins in compliance with data protection regulations.

4.1 Facebook

Our website uses the Facebook Pixel, an analytics tool provided by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, to measure conversions.

The Facebook Pixel allows us to track user behaviour after they are redirected to our website by clicking on a Facebook advertisement.
This helps us analyse the effectiveness of our ads and optimise future campaigns.

The data collected via the Facebook Pixel is anonymous to us and cannot be used to identify individual users.
However, Facebook may associate this data with user profiles and use it for its own advertising purposes in accordance with Facebook’s Data Usage Policy.
This enables Facebook to display targeted ads both on and outside of the platform.

You can disable Facebook Pixel tracking via the Google Tag Manager pop-up or in your Facebook ad settings.
If you do not have a Facebook account, you can disable interest-based advertising through the European Interactive Digital Advertising Alliance website:
http://www.youronlinechoices.com/nl/uw-advertentie-voorkeuren

4.2 Twitter

Our website includes features provided by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA.

By using Twitter and the “Retweet” function, the websites you visit are linked to your Twitter account and shared with other users.
These data are processed by Twitter.

For more information on how Twitter processes personal data, please refer to their Privacy Policy:
https://twitter.com/privacy

If you do not want Twitter to associate your visit to our website with your Twitter account, please log out of Twitter before visiting our site.

4.3 Instagram

Our website uses social plug-ins from Instagram, a service provided by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

To better protect your data, these buttons are not directly embedded but integrated as HTML links.
This means no connection to Instagram’s servers is established when you visit our website.
Only when you click the button will a new window open with Instagram’s site, where you may log in and interact with the plug-in.

For more details on how Instagram handles your data, please visit their Privacy Policy:
https://help.instagram.com/155833707900388

4.4 LinkedIn

Our website uses plug-ins from LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

When you visit a LinkedIn page via our website, a connection to LinkedIn’s servers is established.
LinkedIn is informed of your IP address and that you have visited our website.
If you click the “Recommend” button while logged into your LinkedIn account, LinkedIn may associate your visit with your user profile.

More information can be found in the LinkedIn Privacy Policy:
https://www.linkedin.com/legal/privacy-policy

5. Analysis tools and advertising

5.1 Google Analytics

This website uses functions of the web analytics service Google Analytics, operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called cookies, which are text files stored on your computer that allow an analysis of your website usage. The information generated by these cookies about your use of this website is generally transmitted to a Google server in the United States and stored there.

The storage of Google Analytics cookies and the use of this analytics tool are based on Article 6(1)(f) GDPR.
The website operator has a legitimate interest in analysing user behaviour to optimise both the website and advertising.

5.1.1 Demographic Features in Google Analytics

This website uses the “Demographics” feature of Google Analytics. This allows reports to be created containing information about the age, gender, and interests of website visitors.
These data are derived from interest-based advertising by Google and from third-party visitor data. They cannot be linked to a specific individual.

You can disable this feature in your Google Account’s ad settings, or generally prevent Google Analytics from collecting your data as described in the section “Objection to Data Collection.”

5.2 IP Anonymisation

We have activated the IP anonymisation feature on this website.
This means that Google shortens your IP address within the European Union or other signatory states of the Agreement on the European Economic Area before transmission to the United States.
Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there.

Google uses this information on behalf of the website operator to evaluate your use of the website, compile reports on website activity, and provide other services related to website and internet usage.
The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

5.3 Browser Plug-in

You can prevent the storage of cookies by adjusting your browser settings. However, doing so may limit some functions of this website.

You can also prevent Google from collecting and processing data generated by cookies (including your IP address) by downloading and installing the browser plug-in available at:
https://tools.google.com/dlpage/gaoptout

Alternatively, you can disable data collection by Google Analytics by clicking this link: Deactivate Google Analytics.
An opt-out cookie will be set, preventing future data collection when visiting this website.

More information on how Google handles user data can be found in Google’s privacy policy:
https://support.google.com/analytics/answer/6004245

We have signed a data processing agreement with Google and fully comply with the stringent requirements of EU data protection authorities regarding the use of Google Analytics.

5.4 Remarketing

Our website uses Google Analytics Remarketing combined with the cross-device features of Google Ads and Google DoubleClick, provided by Google Ireland Limited, Dublin.

This function allows the advertising audiences created by Google Analytics Remarketing to be linked with Google Ads’ cross-device capabilities.
This enables personalised advertising messages based on your previous browsing behaviour on one device (for example, a smartphone) to appear on another device (for example, a desktop).

If you have given consent, Google links your web and app browser history to your Google account so that personalised ads can be displayed on all logged-in devices.
For this purpose, Google Analytics temporarily associates verified user IDs with our analytics data to define and build cross-device audiences.

You can opt out of cross-device remarketing permanently by disabling personalised ads in your Google account:
https://www.google.com/settings/ads

Data in your Google account is combined only with your consent (Art. 6(1)(a) GDPR).
If you don’t have a Google account or have objected to data merging, data collection is based on Art. 6(1)(f) GDPR, reflecting our legitimate interest in anonymised visitor analysis for marketing purposes.

You can also disable Google Analytics through the Google Tag Manager pop-up.

More information on data protection can be found in Google’s Privacy Policy:
https://policies.google.com/privacy

5.5 Google Ads (AdWords) and Conversion Tracking

This website uses Google Ads, an online advertising service by Google Ireland Limited, Dublin.

As part of Google Ads, we use conversion tracking.
When you click on an ad placed by Google, a conversion tracking cookie is set on your device.
These cookies expire after 30 days and do not personally identify users.

If a user visits specific pages on our site before the cookie expires, we and Google can see that they clicked the ad and were redirected to our site.

Each Google Ads customer receives a unique cookie, which means cookies cannot be tracked across Ads clients’ websites.
The information gathered is used to compile conversion statistics for Ads customers who use conversion tracking.

If you prefer not to participate, you can disable this by deactivating the Google Conversion Tracking cookie in your browser settings.

The storage of conversion cookies and use of this tracking tool are based on Art. 6(1)(f) GDPR, as the website operator has a legitimate interest in analysing user behaviour to improve both its website and advertising.

5.6 Google Tag Manager

We may also use Google Tag Manager to integrate and manage Google analytics and marketing services on our website.

For more information on Google Ads and Conversion Tracking, please refer to:
https://policies.google.com/privacy

You can also configure your browser to be notified when cookies are set and allow them only in individual cases, exclude them altogether, or automatically delete cookies when closing the browser.

5.7 Hotjar

This website uses Hotjar, operated by Hotjar Ltd., Level 2, St Julian’s Business Centre, 3 Elia Zammit Street, St Julian’s STJ 1000, Malta, Europe (https://www.hotjar.com).

Hotjar helps us analyse how users interact with our website — for example, by tracking mouse movements, clicks, and scrolling behaviour.
It can also record how long your cursor stays over certain elements and create heatmaps showing which areas of the site attract the most attention.

Hotjar can track how long users stay on pages, when they leave, and at which point they abandon form inputs (conversion funnels).
It may also collect direct feedback from visitors to improve our services.

Hotjar uses cookies that make our services more efficient and secure. These remain stored until manually deleted.

You can configure your browser to manage or block cookies; however, disabling cookies may limit functionality.

Use of Hotjar and storage of its cookies are based on Art. 6(1)(f) GDPR, reflecting our legitimate interest in analysing user behaviour for optimisation purposes.

To deactivate Hotjar, click this link and follow the instructions:
https://www.hotjar.com/opt-out

Note: Hotjar deactivation must be done separately for each browser or device.
You can also disable Hotjar via the Google Tag pop-up.

We have signed a data processing agreement with Hotjar in compliance with EU data protection regulations.

5.8 HubSpot

We use HubSpot on our website for online marketing purposes.
HubSpot is a US-based software company with a subsidiary in Ireland:

HubSpot, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland
Phone: +353 1 5187500

HubSpot enables visitors to our website to learn more about our company, download content, and provide contact details or demographic information.
This data is stored on HubSpot’s servers and helps us communicate with website visitors and understand which of our services interest them most.
All collected data are handled in accordance with this Privacy Policy and used solely to improve our marketing activities.

We also use HubSpot’s live chat service (“Messages”) to send and receive messages with visitors on certain pages.
If you use this feature, the following data may be transmitted to HubSpot’s servers:

  • Content of all chat messages sent and received

  • Contextual information (e.g., page on which the chat occurred)

  • Optional: user email address (if provided)

The legal basis for using HubSpot’s services is Art. 6(1)(f) GDPR, representing our legitimate interest in optimising our marketing and customer service experience.

6. Newsletter

6.1 Newsletter Data

If you would like to receive the newsletter offered on our website, we require your email address and information that allows us to verify that you are the owner of the provided email address and that you consent to receiving the newsletter. No additional data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not share it with third parties.

The processing of the data entered in the newsletter registration form is carried out solely based on your consent (Art. 6(1)(a) GDPR).
You may revoke your consent to the storage of your data, email address, and its use for newsletter delivery at any time, for example by clicking the "Unsubscribe" link in the newsletter.
The legality of the data processing carried out prior to your withdrawal remains unaffected.

The data you provide to subscribe to the newsletter will be stored by us until you unsubscribe from the newsletter, after which it will be deleted.
This does not affect data that we store for other purposes.

6.2 MailChimp

This website uses the services of MailChimp for sending newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service that helps manage and analyse newsletter distribution. When you enter data to subscribe to our newsletter (e.g., your email address), it is stored on MailChimp’s servers in the United States.

MailChimp is certified under the EU-US Privacy Shield, an agreement between the European Union and the United States designed to ensure compliance with European data protection standards in the U.S.

Using MailChimp allows us to analyse our newsletter campaigns.
When you open an email sent via MailChimp, a file contained in the email (known as a web beacon) connects to MailChimp’s servers in the U.S.
This enables us to determine whether a newsletter message has been opened and which links have been clicked.
Technical data is also collected (e.g., time of access, IP address, browser type, and operating system).
This information cannot be attributed to individual recipients and is used solely for statistical analysis to help tailor future newsletters to recipients’ interests.

If you do not wish to have your usage analysed by MailChimp, you must unsubscribe from the newsletter.
Each newsletter email contains a link for this purpose.
You can also unsubscribe directly on our website.

Data processing takes place based on your consent (Art. 6(1)(a) GDPR).
You may withdraw your consent at any time by unsubscribing from the newsletter.
The legality of processing prior to withdrawal remains unaffected.

The data you have provided for receiving the newsletter will be stored by us until you unsubscribe.
Once you have unsubscribed, the data will be deleted both from our servers and those of MailChimp.
This does not affect data that we store for other purposes.

For more information, please refer to MailChimp’s privacy policy:
https://mailchimp.com/legal/terms/

Data Processing Agreement with MailChimp

We have concluded a so-called Data Processing Agreement (DPA) with MailChimp, in which MailChimp commits to protecting our customers’ data and not disclosing it to third parties.
This agreement can be viewed at:
https://mailchimp.com/legal/forms/data-processing-agreement/

7. Plugins and Tools

7.1 YouTube with Extended Data Protection Mode

Our website uses plug-ins from the YouTube platform. The operator of these pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.
We use YouTube in extended data protection mode. According to YouTube, this mode ensures that YouTube does not store information about visitors to this website unless they play a video. However, the transmission of data to YouTube partners is not necessarily excluded by the extended data protection mode.
Regardless of whether you watch a video, YouTube establishes a connection to the Google DoubleClick network.

When you start a YouTube video on our website, a connection is made to YouTube’s servers. The YouTube server is informed which of our pages you have visited. If you are logged in to your YouTube account, YouTube can directly associate your browsing behaviour with your personal profile. You can prevent this by logging out of your YouTube account before playing videos.

Once a video starts, YouTube may also store various cookies on your device. These cookies enable YouTube to collect information about visitors to our website. This information is used, among other things, to compile video statistics, improve user experience, and prevent fraud attempts. The cookies remain stored on your device until you delete them.

After starting a YouTube video, additional data processing operations may be triggered, over which we have no control.

The use of YouTube is based on Article 6(1)(f) GDPR and reflects our legitimate interest in providing an appealing online presence.

For more information about YouTube’s handling of user data, please refer to their privacy policy:
https://policies.google.com/privacy

For more information, please refer to LinkedIn’s privacy policy:
https://www.linkedin.com/legal/privacy-policy
